Welcome to ToyzTracker. These Terms and Conditions (“Terms”) govern your use of our mobile application (“App”) provided by ToyzTracker, located in Montreal, Quebec. By accessing or using our App, you agree to these Terms. If you do not agree, please do not use our services.

1. ACCEPTANCE OF TERMS

By logging into ToyzTracker, you agree to these Terms, including our Privacy Policy, which is hereby incorporated by reference. You affirm that you are at least 13 years old or have the consent of a parent or guardian to use the App.

2. PURPOSE OF THE APP

ToyzTracker is intended for entertainment purposes only. Users can inventory their action figure collection from Hot Toys in 1:6, 1:4, and 1:1 scale.

3. USER ACCOUNTS AND LOGIN

Users must create an account to use the App.
You agree to provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your login credentials and passwords.
You agree not to share your password or login details with any third party.

4. USER RESPONSIBILITIES AND PROHIBITIONS

You shall not attempt to access the App through unauthorized means.
You agree not to misuse, interfere with, or disrupt the App or servers.
You shall not upload or transmit any harmful, illegal, or infringing content.
You agree not to share your account details or password with others.

5. INTELLECTUAL PROPERTY RIGHTS

All content, including images, logos, text, and interface elements, are owned or licensed by ToyzTracker and are protected by applicable intellectual property laws. You may use the App for personal, non-commercial purpose only.

6. SYSTEM AVAILABILITY AND SECURITY

We strive to maintain the availability and security of the App, but we do not guarantee 100% uptime or security.
We operate on a best-effort basis and shall not be liable for any interruptions, security breaches, or data loss.

7. LIABILITY AND DISCLAIMERS

The App is provided “as is” and “as available,” without warranties of any kind.
ToyzTracker disclaims liability for damages resulting from use, inability to use, or reliance on the App.
We do not endorse or warrant the accuracy or completeness of user-generated content.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, ToyzTracker, its affiliates, officers, or employees shall not be liable for any damages, including direct, indirect, incidental, consequential, or punitive damages arising from or related to your use of the App.

9. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. All disputes shall be resolved exclusively within the competent courts of Montreal, Quebec.

10. MODIFICATION OF TERMS

We reserve the right to modify these Terms at any time. Changes will be effective upon posting within the App. Your continued use constitutes acceptance of the revised Terms.

11. TERMINATION

We may terminate or suspend your access at any time for violations of these Terms or for any other reason without notice.

12. MISCELLANEOUS

These Terms constitute the entire agreement regarding your use of the App.
If any provision is held invalid, the remaining provisions shall remain in effect.
No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other.
